Man gets 14 years' probation in car burglaries, drug sale in school zone

ELIZABETHTON — A man who was facing 18 counts of car burglaries and three counts of burglary of structures, sale of methamphetamine in a school zone, criminal trespassing and two counts of possession of drug paraphernalia was sentenced to 14 years of community probation as part of a plea bargain.

Dennis William Harvey, 28, entered his guilty pleas in Carter County Criminal Court on Friday. His attorney was David Crockett.

The effective sentence of 14 years’ probation was a result of several concurrent and consecutive sentences from the convictions. Judge Stacy Street sentenced Harvey to eight years’ probation on the guilty plea of selling methamphetamine in a drug-free school zone.

That sentence was contingent on Harvey entering a long-term substance abuse treatment program and cooperating with prosecutors.

Street also fined Harvey $2,000 and ordered him to pay of fee of $250 to the Drug Testing Fund.

Harvey also received six years’ probation on a guilty plea to an auto burglary charge and another six years’ probation on a guilty plea on a burglary of a building charge.

Street ordered those two sentences to run concurrently, but consecutive to the drug-free school zone violation. Both of the six-year sentences will start when the sentence on the drug-free school zone violation expires. There was also $50 fines assessed on each of the two convictions and restitution was reserved. There were 18 other car burglaries to which Harvey admitted guilt, but the charges were dismissed in the plea bargain. Harvey agreed to pay restitution in those cases. Two charges of possession of drug paraphernalia and one count of criminal trespassing were also dismissed.

The drug-free school zone violation was from an alleged sale of crystal methamphetamine on July 12, 2016, at a location within 1,000 feet of Elizabethton High School. Harvey also told police he had been involved in car burglaries on Parkway Boulevard, West F Street, West D Street, and a garage on Willow Street.
